1. Definitions

“You” and “Your” refer to any user of Buff-N-Shine Car Wash services, including individuals who purchase or use car wash packages, memberships, or other services provided at our premises.

“We,” “Us,” and “Our” refer to Buff-N-Shine Car Wash, its employees, affiliates, and any other parties acting on behalf of Buff-N-Shine.

“Services” refer to the car wash packages, membership plans, detailing services, and other offerings provided by Buff-N-Shine.

“Membership” refers to the subscription-based car wash plans that are billed on a recurring monthly basis and tied to a specific vehicle.
2. Introduction
By purchasing, subscribing to, or using any of the services provided by Buff-N-Shine Car Wash, you agree to be bound by these Terms of Service. These terms govern the specific conditions under which services are provided. 3. Services Provided
3.1. Car Wash Packages
Buff-N-Shine offers several car wash packages tailored to different service levels. The details and pricing of each package are available at our on-site kiosks and on our website.
Please note that additional services such as detailing may be offered on an as-available basis and may require separate scheduling.
3.2 Membership Services
Buff-N-Shine provides membership plans for regular customers at a fixed monthly fee. Membership services are limited to the vehicle registered at the time of sign-up and cannot be transferred to another vehicle unless otherwise permitted under the transfer policy (see Section 5). Membership plans are subject to availability and can be canceled or modified according to the terms outlined below.

4. Purchasing and Payments
4.1 On-Site Purchases
All car wash services and memberships must be purchased in person at our premises using the kiosks managed by our third-party point-of-sale provider. Buff-N-Shine does not accept any other forms of payment outside this system.
4.2 Payment Processing
Payments for both one-time services and memberships are processed securely by a third-party provider. Buff-N-Shine is not responsible for any payment issues such as card declines or processing errors. 5. Membership Terms
5.1 Billing
Membership fees are billed monthly to your credit or debit card automatically. Billing occurs on the date you signed up for the membership and recurs on the same date each month. It is your responsibility to ensure that payment information is up-to-date. Failure to process the payment due to card expiration or insufficient funds may result in suspension or cancellation of the membership.
5.2 License Plate Recognition
Each membership is tied to a single vehicle, identified through our license plate recognition system. When the registered vehicle enters the car wash, the system scans the license plate to retrieve the membership details. If a new vehicle is purchased, you may transfer the membership to the new vehicle after registering it with Buff-N-Shine, subject to approval.
5.3 Cancellation
You may cancel your membership at any time by providing a 15-day notice via email to buffnshinecarwash@gmail.com or in person at our kiosk. Membership services will remain active until the end of the current billing cycle, and no refunds will be issued for unused services.

5.4 Non-Transferability
Memberships are non-transferable between individuals or vehicles, except in the case of a new vehicle purchase. If you wish to transfer your membership to a new vehicle, you must notify Buff-N-Shine, and the transfer will only take effect once the new vehicle is registered in our system.
6. Service Availability
6.1 Operational Hours
Buff-N-Shine car wash services are available during operating hours, which may vary depending on weather conditions, holidays, maintenance, or other operational factors. We aim to provide uninterrupted service but cannot guarantee the availability of services at all times.
6.2 Service Interruptions
In the event of temporary service interruptions due to weather conditions, repairs, or unforeseen mechanical issues, we will notify customers through on-site signage and, where possible, email notifications for members. Buff-N-Shine is not liable for any losses or damages resulting from temporary service unavailability.

7. User Responsibilities
7.1 Vehicle Preparation
Before using our services, you are responsible for ensuring your vehicle is in a suitable condition for washing. This includes securing windows, closing sunroofs, and removing personal belongings from the interior of the vehicle. Buff-N-Shine is not liable for damage to vehicles resulting from pre-existing conditions, negligence, or failure to prepare the vehicle properly.
7.2 License Plate Accuracy
The accuracy of the license plate information registered with us is your responsibility. Incorrect or outdated registration details may result in the denial of services. Please ensure that the vehicle details in your membership account are up to date.

8. Termination of Services
8.1 Right to Terminate
Buff-N-Shine reserves the right to terminate or suspend any services, including memberships, in cases where violations of these Terms of Service or any fraudulent activities are detected. This includes attempting to use the membership for multiple vehicles or engaging in any illegal activity while using Buff-N-Shine services.
8.2 Changes to Services
Buff-N-Shine may modify, suspend, or terminate any of its services or memberships at its discretion, provided that notice is given to users. Continued use of services after changes have been made signifies acceptance of the updated terms.

9. Liability
Buff-N-Shine is not liable for any damages that occur to vehicles unless they are caused by proven negligence during service delivery. This includes but is not limited to minor cosmetic damage, damage from normal wear and tear of our mechanical systems, or weather-related damage.
We are also not liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or time, resulting from the use of our services or temporary service unavailability.

10. Indemnification
You agree to indemnify and hold harmless Buff-N-Shine, its employees, affiliates, and service providers from any claims, damages, expenses, or legal fees arising from your violation of these Terms of Service or from your use of our services.

11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California. Any legal disputes arising from these terms or the use of Buff-N-Shine services will be resolved in the courts located in Orange County, California.
